  • Trespassers are individuals who enter the property without permission. Property owners do not owe trespassers any duty of care, unless they create a dangerous condition that injures the trespasser.

In addition to the status of the individual, the premises liability laws in Idaho also consider the type of injury that occurred. Property owners are more likely to be liable for serious injuries, such as those that result in death or permanent disability.
