Motor Vehicle Personal Injury Laws in Idaho
Below is a summary of the key points regarding car accident liability and civil action laws in Idaho. Every car accident incident and scenario is unique. You should consult an attorney for advice regarding your individual situation.
- Fault-Based Insurance System: Idaho operates under a traditional fault-based motor vehicle insurance system. If you're injured in an accident that was the other driver's fault, you can file an insurance claim or a lawsuit against the at-fault driver to recover compensation for your injuries and losses. This compensation can include both special (economic) damages, such as medical bills and lost income, and general (noneconomic) damages, like pain and suffering, and emotional distress.
- Statute of Limitations: For most personal injury claims in Idaho, you have two years from the date you were injured to file a lawsuit in court. There are exceptions and special time limits that apply in certain circumstances, such as when the injured party is a minor or when the responsible party leaves the state.
- Claims Against the Government: Special time limits apply to personal injury claims against Idaho, its political subdivisions, and their employees.
