Motor Vehicle Personal Injury Laws in Idaho
Below is a summary of the key points regarding motor vehicle accident liability and civil action laws in Idaho. For a more detailed explanation of how these laws work in practice, including Idaho's comparative fault rules and recoverable damages, we've put together a comprehensive overview for injury victims. Every car accident incident and scenario is unique. You should consult an attorney for advice regarding your individual situation.
- Fault-Based Insurance System: Idaho operates under a traditional fault-based motor vehicle insurance system. If you're injured in an accident that was the other driver's fault, you can file an insurance claim or a lawsuit against the at-fault driver to recover compensation for your injuries and losses. This compensation can include both special (economic) damages, such as medical bills and lost income, and general (noneconomic) damages, like pain and suffering, and emotional distress.
- Statute of Limitations: For most personal injury claims in Idaho, you have two years from the date you were injured to file a lawsuit in court. There are exceptions and special time limits that apply in certain circumstances, such as when the injured party is a minor or when the responsible party leaves the state.
- Claims Against the Government: Special time limits apply to personal injury claims against Idaho, its political subdivisions, and their employees. Before you can sue Idaho or its employees in court for your personal injury claim, you must file your notice of tort claim within 180 days after the date you were injured.
- Comparative Negligence Rule: Idaho has a "modified comparative negligence" rule. You can recover some damages for your injuries, as long as you aren't found to be 50% or more to blame for the accident. If you're found to be 50% or more at fault, Idaho law bars you from collecting any damages. Determining fault often requires examining the specific behaviors that led to the collision. According to Idaho Transportation Department data, distraction, tailgating, and failure to yield account for the largest share of crashes on our roads. Understanding these patterns can help clarify how negligence may be established in your case.
- Damage Caps: Idaho law puts a $250,000 cap on noneconomic damages, such as pain and suffering and emotional distress except in certain cases involving willful or reckless misconduct. This cap is adjusted annually for inflation. As of July 1, 2022, the adjusted cap amount was $430,740.
