In this type of case, the retailer and advertising company, and possibly the manufacturer, may have legal liability.

Failure To Warn Of Improper Use May Cause Injury To A Consumer

The manufacturer should provide written warnings in the instructions or attached to the product itself warning of the dangers of potential improper use. For example, a ladder manufacturer must provide a label specifying the maximum weight the ladder can bear. The manufacturer of an electric appliance may need to specify not to immerse the appliance in water. The absence of such a warning may be negligent on the part of the manufacturer.

Product Recalls Affect Products Liability

Manufacturers recall products that they have learned may be defective and possibly harm consumers. The manufacturers must make reasonable efforts to inform all purchasers of the recall and must repair or replace the product at their own expense. Product liability laws in Idaho are based on the concepts of negligence, strict liability, and breach of warranty. Civil actions for product liability are defined in Idaho Statutes: Title 6, Chapter 14.

  • Strict liability is a legal doctrine that holds a manufacturer or seller liable for injuries caused by a defective product, regardless of whether the manufacturer or seller was negligent. In Idaho, strict liability applies to products that are defective in design, manufacturing, or labeling.
  • Breach of warranty is a legal doctrine that holds a manufacturer or seller liable for injuries caused by a product that does not meet the promises made about it. In Idaho, there are two types of warranties: express warranties and implied warranties. Express warranties are promises made by the manufacturer or seller about the product. Implied warranties are promises that are implied by law, such as the implied warranty of merchantability, which promises that a product is fit for the ordinary purpose for which it is sold.

To be successful in a product liability claim in Idaho, a plaintiff must prove all of the following elements:

  • The product was defective.
  • The defect caused the plaintiff's injuries.
  • The plaintiff was using the product in a reasonably foreseeable way.
  • The plaintiff suffered damages as a result of their injuries.

If a plaintiff can prove all of these elements, they may be able to recover damages for their medical expenses, lost wages, pain and suffering, and other losses.

The statute of limitations for product liability claims in Idaho is two years from the date of the injury. This means that a plaintiff must file their lawsuit within two years of the date they were injured.
